Privacy Policy

Lakeview Women's Fitness Club LLC, doing business as LEAP — Lakeview East Athletics and Performance (“LEAP,” “we,” “us,” or “our”), respects your privacy. This Privacy Policy explains what information we collect from members, prospective members, and visitors to our website at https://www.leapchicago.com (the “Site”), how we use it, who we share it with, and the choices and rights you have. LEAP is a coaching-led personal training and small-group strength facility located at 1057 W Belmont Avenue, Chicago, IL 60657, in East Lakeview, near the Belmont CTA. LEAP serves adult members of all genders.

1. Scope of this Policy

This Policy applies to information we collect:

  • through the LEAP website, including any forms you submit, pages you visit, and content you interact with;

  • when you book a Starting Point, Onboarding Session, or any LEAP service;

  • when you become a LEAP member or use our member-facing services (TeamUp portal, Myzone heart-rate tracking, the LEAP App, etc.);

  • through email, phone, text, or in-person communications with LEAP staff;

  • when you visit the LEAP facility (including any in-facility cameras, sign-in records, and visitor logs).

This Policy does not cover information practices of third-party websites or apps that we link to but do not operate. When you click through to a third-party service (TeamUp, Myzone, payment processors, social media), the privacy policy of that service governs your interaction with it. We identify the major third parties we work with in Section 5.

2. Information We Collect

2.1 Information you provide directly

  • Contact details: name, email address, phone number, postal address (when supplied).

  • Account and membership details: membership tier (Silver, Gold, Platinum, Diamond, Crown, or Barbell Club), payment method on file (handled by our processor — we do not store full card numbers), billing history.

  • Health and fitness profile: training goals, training history, injury and pain history, movement-assessment results, body-composition data (if you choose to track it), notes from your coach about your programming.

  • Liability waiver and PAR-Q (Physical Activity Readiness Questionnaire) responses, including any medical conditions or medications you disclose for safety purposes.

  • Communications you send us — emails, text messages, voicemails, and any feedback or testimonials you provide.

  • Marketing preferences (whether you have opted in to email or SMS communications).

2.2 Information collected automatically when you use the Site

  • Device and browser data: IP address, browser type and version, operating system, referring URL, and approximate location derived from IP.

  • Usage data: pages viewed, time on page, links clicked, scroll depth, and interactions with forms and CTAs.

  • Cookies and similar technologies — see Section 7 for details and your choices.

2.3 Information collected during training and at the facility

  • Heart-rate and effort data (via Myzone MZ-3, MZ-Switch, or other Myzone devices) when you wear a Myzone belt during a coached session. This data is tied to your Myzone account.

  • Performance and progress data: lifts, weights, reps, mock-meet results (Barbell Club), Personal Training session notes, and any data you log in the LEAP App.

  • Attendance records: which sessions you attended, no-show records, late-cancel records, and class capacity tracking via TeamUp.

  • Video and photography: we may record session footage or take photos for coaching review, member-progress documentation, or marketing. We will ask before publishing identifiable images of you to social media or marketing materials, and you can revoke consent at any time.

  • Facility surveillance: LEAP maintains security cameras at the Belmont facility. Footage is retained for a limited period for safety and security purposes only and is not used for marketing or shared except as required by law or to investigate an incident.

2.4 Information from third parties

  • Information you authorize us to receive from connected services (e.g., Myzone, the LEAP App on TeamUp).

  • Public information from review platforms (e.g., Google Business Profile reviews you publish about LEAP).

  • Referral information when an existing member refers you (typically just name and email).

3. How We Use Your Information

We use the information described above to:

  • deliver coaching, programming, and the services you have signed up for;

  • schedule sessions, process payments, and manage your membership;

  • communicate with you about your training, billing, schedule changes, facility updates, and policy changes;

  • personalize your training based on your goals, history, and Myzone or LEAP App data;

  • ensure your safety in coached sessions (your coach reviews your PAR-Q, injury history, and any medical disclosures before programming);

  • operate, maintain, and improve the Site and our services;

  • send you marketing communications (only if you have opted in), including new program announcements, event invitations, and educational content. You can opt out at any time — see Section 8;

  • comply with legal obligations, respond to lawful requests, prevent fraud, and protect the rights and safety of LEAP, our members, and the public;

  • aggregate and de-identify data for analytics and service improvement (de-identified data is no longer associated with you and is not subject to this Policy).

We do not sell your personal information. We do not share your personal information with third parties for their own marketing purposes.

4. Why We Are Allowed to Process Your Information

Depending on your state of residence and the type of processing, our legal basis may include:

  • Your consent (e.g., marketing emails, photo/video consent, optional health-data sharing).

  • Performance of a contract (e.g., processing your membership, scheduling your sessions, billing).

  • Our legitimate interests in operating, securing, and improving our services, where those interests are not overridden by your rights.

  • Compliance with legal obligations (e.g., tax records, responding to subpoenas, BIPA disclosures if applicable).

5. Service Providers and Third Parties

We share information with service providers (“processors”) who help us run LEAP. They are contractually limited to using your information only to perform services for us. The major providers are:

  • Wix.com (hosting and site analytics): Wix hosts the Site at https://www.leapchicago.com and provides built-in analytics. Wix's privacy practices are governed by the Wix Privacy Policy at https://www.wix.com/about/privacy.

  • TeamUp (member management, scheduling, payments, LEAP App): TeamUp processes member accounts, scheduling, attendance, recurring payments, and powers the LEAP App. Information you provide to your member account — contact details, payment method, attendance history, and billing — is stored and processed by TeamUp on our behalf. TeamUp's privacy policy is at https://goteamup.com/privacy/.

  • Myzone (heart-rate and effort tracking): If you use a Myzone device during sessions, your heart-rate and derived effort data are stored in your Myzone account and synced to LEAP coaches and (optionally) the LEAP App. You control your Myzone account directly. Myzone's privacy policy is at https://www.myzone.org/privacy-policy.

  • Payment processor: Card payments are tokenized and processed by our payment processor through TeamUp. We do not store full card numbers on our systems. Tokenized payment methods are stored only as needed to process recurring membership billing.

  • ActiveCampaign (marketing email and automation): If you opt in to marketing communications, we use ActiveCampaign to manage our email lists, send newsletters and promotional content, and run lifecycle/automation flows. ActiveCampaign processes your name, email address, and engagement data (opens, clicks). ActiveCampaign's privacy policy is at https://www.activecampaign.com/legal/privacy-policy.

  • TeamUp (transactional email and SMS): TeamUp sends transactional and operational messages on our behalf — booking confirmations, schedule changes, billing receipts, and member-account notifications. TeamUp may also send class reminders via email or SMS based on your notification settings. See TeamUp's privacy policy at https://goteamup.com/privacy/.

  • Google Analytics: Google Analytics is installed on the Site and helps us understand which pages are visited and how the Site is used. Google Analytics may set its own cookies and collect IP address, device data, and usage data. Information is processed by Google in accordance with the Google Privacy Policy at https://policies.google.com/privacy. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on at https://tools.google.com/dlpage/gaoptout.

  • Meta (Facebook and Instagram advertising): LEAP occasionally runs advertising campaigns on Facebook and Instagram. When campaigns are active, the Meta Pixel and/or Conversions API may be used on the Site to measure ad performance, build custom audiences (e.g., people who visited a specific page), and deliver retargeted ads to you on Meta platforms. The Meta Pixel collects Site interaction data (pages viewed, button clicks, form submissions) and may share it with Meta. Meta's privacy policy is at https://www.facebook.com/privacy/policy. You can opt out of Meta-based advertising in your Facebook/Instagram ad preferences.

We may also disclose information when legally required (subpoenas, court orders, regulatory requests), to enforce our agreements, to protect rights/safety, or in connection with a sale or transfer of all or part of LEAP's business (in which case we will require the recipient to honor this Policy).

6. Illinois Biometric Information Privacy Act (BIPA)

LEAP is located in Illinois and we follow the requirements of the Illinois Biometric Information Privacy Act, 740 ILCS 14 (“BIPA”). BIPA defines a “biometric identifier” as a retina or iris scan, fingerprint, voiceprint, or scan of hand or face geometry. “Biometric information” means any information based on a biometric identifier that is used to identify an individual.

6.1 What we do not collect

LEAP does not collect, capture, purchase, receive through trade, or otherwise obtain biometric identifiers or biometric information from members or visitors. Specifically, we do not use:

  • fingerprint or thumbprint check-in;

  • facial-recognition entry or check-in systems;

  • retina or iris scanners;

  • voiceprint identification;

  • hand-geometry scanners.

6.2 Heart-rate and other fitness data

Heart-rate data, training-volume data, and similar fitness metrics collected via Myzone or in-session tracking are not “biometric identifiers” under BIPA. We treat this data as health and fitness information and protect it as described in Sections 2.3, 3, and 9 of this Policy. We do not use heart-rate data to identify you (your Myzone account is what associates the data with you, not the heart-rate data itself).

6.3 If we ever change this practice

If LEAP at any point in the future implements a system that collects biometric identifiers or biometric information as defined by BIPA, we will, before collecting any such data: (a) inform affected individuals in writing, (b) inform them of the specific purpose and length of term for which the data will be collected, stored, and used, (c) obtain a written release executed by each individual, and (d) publish a written retention schedule and destruction guidelines. We will not sell, lease, trade, or otherwise profit from biometric data.

7. Cookies and Similar Technologies

Our Site uses cookies and similar technologies (web beacons, pixels) to operate the Site, analyze usage, and — when active campaigns are running — measure marketing performance and deliver retargeted ads.

  • Strictly necessary cookies: Required for the Site to function (session, security, load balancing). These cannot be disabled.

  • Analytics cookies: Help us understand which pages are visited and how the Site is used. We use Wix's built-in analytics and Google Analytics. These cookies do not directly identify you and are used in aggregate.

  • Marketing/advertising cookies and pixels: Set when LEAP is running advertising campaigns. The Meta Pixel (Facebook/Instagram) collects Site interaction data to measure ad effectiveness and deliver retargeted ads on Meta platforms. These are set only with your consent in jurisdictions that require it. You can manage these in our cookie banner and in your Meta ad preferences.

You can manage cookie choices through the cookie banner on your first visit and in your browser's settings. Note that disabling some cookies may affect Site functionality.

8. Your Privacy Rights

Depending on where you live, you may have specific rights regarding your personal information. We extend the rights below to all U.S. residents regardless of state, even where the underlying state law has not yet been enacted, except where doing so would conflict with our legal obligations.

8.1 Rights available to U.S. residents

  • Right to know / access: You can request a copy of the personal information we have collected about you, the categories of sources, the purposes of collection, and the categories of third parties with whom we share it.

  • Right to delete: You can request that we delete personal information we have collected from you, subject to exceptions (e.g., information needed to complete a transaction, comply with legal obligations, or detect security incidents).

  • Right to correct: You can request that we correct inaccurate personal information we hold about you.

  • Right to data portability: You can request a copy of your information in a portable, machine-readable format.

  • Right to opt out of “sale” or “sharing” for cross-context behavioral advertising: LEAP does not sell personal information for money. When we run advertising campaigns on Facebook or Instagram, the Meta Pixel may transmit Site interaction data to Meta to measure ads and build retargeting audiences. Under California's CPRA this may constitute “sharing” for cross-context behavioral advertising. You can opt out by emailing matt@leapchicago.com with the subject “Do Not Share My Info,” by using the cookie banner to decline marketing/advertising cookies, or by using a Global Privacy Control (GPC) signal in your browser, which we honor.

  • Right to limit use of sensitive personal information: Where we collect sensitive personal information (e.g., precise geolocation, health data), you may limit its use to the purposes necessary to provide the requested services.

  • Right to opt out of profiling and automated decisions: LEAP does not make solely automated decisions that produce legal or similarly significant effects. Coaching decisions are made by human coaches.

  • Right to non-discrimination: We will not discriminate against you for exercising any privacy right.

8.2 California residents (CCPA / CPRA)

California residents have all of the rights above and may also designate an authorized agent to exercise rights on their behalf. We do not knowingly sell or share the personal information of consumers under 16. We retain personal information for the purposes described in Section 9.

8.3 Virginia, Colorado, Connecticut, Utah residents (VCDPA, CPA, CTDPA, UCPA)

Residents of Virginia, Colorado, Connecticut, and Utah have the rights to access, delete, correct (Virginia, Colorado, Connecticut), and port their personal information, and to opt out of the sale of personal information, targeted advertising, and (where applicable) profiling. To exercise any of these rights, contact us as described in Section 8.5. If we deny your request, you have the right to appeal — see Section 8.6.

8.4 Texas, Oregon, Montana, Tennessee, Indiana, Iowa, and other state residents

Residents of states with comprehensive privacy laws that have come into effect have substantially the same rights as residents of Virginia, Colorado, Connecticut, and Utah. Residents of states without comprehensive privacy laws are still entitled to the rights in Section 8.1, which we extend voluntarily.

8.5 How to exercise your rights

Email matt@leapchicago.com with the subject line “Privacy Request” and tell us which right you wish to exercise. We will verify your identity (typically by confirming details associated with your member account or recent communication with LEAP) and respond within 45 days. If we need more time, we will let you know.

8.6 Right to appeal

If we deny a request, you may appeal the decision by replying to our denial within 60 days. We will respond to your appeal within 60 days with a written explanation. If your appeal is denied, you may contact your state Attorney General to file a complaint.

9. Data Retention and Security

We retain personal information only as long as necessary for the purposes described in this Policy or as required by law:

  • Member account and billing records: for the duration of your membership and at least 7 years after termination, for tax and accounting purposes.

  • Health/fitness records and waivers: for the duration of your membership and at least 7 years after termination, for safety and liability purposes.

  • Marketing list data: until you opt out or until 24 months of inactivity, whichever comes first.

  • Site analytics data: in aggregate or de-identified form, retained per the analytics provider's policies.

  • Facility surveillance footage: limited retention period (typically 30–90 days unless preserved for an investigation).

We use reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission over the internet or storage is 100% secure, however, and we cannot guarantee absolute security.

10. Children's Privacy

LEAP's services are intended for adults 18 and over. We do not knowingly collect personal information from anyone under 13 in violation of the Children's Online Privacy Protection Act (COPPA). If you believe a minor has provided personal information, please contact us so we can delete it.

11. Changes to This Policy

We may update this Policy from time to time. The “Last updated” date at the top of the Policy reflects the most recent revision. Substantive changes will be communicated through the Site (banner notice) or by email to active members. Continued use of LEAP services after changes take effect constitutes acceptance of the updated Policy.
